'Legislation soon to curb attack on public property'
While replying to the Shiv Sena-BJP sponsored debate on law and order situation in the state, Patil said recent agitations over load-shedding had damaged public property worth Rs15 crore.
Expressing a firm resolve to weed out corruption in the Customs department, Patil announced a prize to anyone who exposed disproportionate property of any corrupt government official. If the person manages to expose property worth Rs1 crore then he will be rewarded with a prize of Rs5 lakh.
Action against Latur board
The State shall take action against officials of the Latur SSC Division Board who were found guilty of increasing marks in lieu of monetary considerations from students, stated Minister for School Education, Vasant Purke. While replying to a debate raised by Shiv Sena's Subhash Desai, Purke said a CID inquiry will be constituted into the incident. It was found that moderators charged Rs1,000 for each mark increased. While moderators even offered to wipe out the wrong answers, and allowing students to rewrite their answers, the board officials made available the bar code number of answer papers for Rs20,000.
Meeting on fenny
The state shall hold a meeting within a week to decide upon a policy for producing alcoholic drinks from fruits, flowers and grain, said Minister for State Excise Ganesh Naik. The meeting shall also decide upon waiving state excise duty on fenny produced from cashewnut fruit in the state. When Opposition Leader Ramdas Kadam pointed out that Konkan farmers were shelling out Rs5 excise per box of cashewnut being sent to Goa for fenny processing, Revenue Minister Narayan Rane assured that he along with the State Excise Minister would ensure local processing of fruits, including cashewnut.
Property transfer case
Deputy CM R R Patil said the Crime Branch shall probe the transfer of property by one Sujit Kumar Solomon, a person not related to the trust that runs the Hume High School and Junior College at Byculla, without any trustees knowledge.
Power, education face CAG rap
The Comptroller and Auditor General of India (CAG) report said, The transmission and distribution losses of the state power company were 32.58 per cent at the end of March 2006, despite a commitment in the MoU with the Centre to bring these down to 18 per cent by March 2003.
The performance of the Mahatransco (a power distributing company) with respect to the prevention/detection of distribution losses was found to be deficient, as preventive measures like periodical inspection and testing of consumers installations, recalibration of meters, checking the premises of permanently disconnected consumers and paid pending cases, and repairs of faulty meters were not effectively implemented.
At a time when the state is reeling under 5,700 MW shortage, the lapse on the governments part to fix the existing infrastructure to minimise the power losses is shocking, the CAG report said.
The Sarva Siksha Abhiyan aimed at universal elementary education has suffered a major setback due to the under-utilisation of funds according to the CAG report, which was tabled in the State Legislative Assembly on Tuesday. The report said, Over a lakh children continued to be out of schools because of improper implementation of the scheme. With the present pace, the objectives of the Sarva Siksha Abhiyan remain a remote possibility.
The report said during 2001-2005, only Rs911.37 crore were available with Maharashtra Prathamik Shikshan Parishad, against the approved outlay of Rs2,155.87 crore. The shortfall of funds released by the Government of India and the State Government was Rs909 cr and Rs335.50 cr respectively. The report also states that despite availability of funds, only 37 per cent of the civic works (construction of class rooms, toilets and provision of drinking water facilities) were taken up due to land problems.
State SEZ it straight
The CM also announced that no piece of farm land be it fertile or not would be acquired by the government if farmers opposed the acquisition process. The state has already appointed a cabinet sub-committee of three senior ministers, headed by Rehabilitation Minister Patangrao Kadam, which would decide on the resettlement and rehabilitation of the project-affected farmers.
However, Deshmukh made it clear that the state government was waiting for the Centre to come up with a fresh SEZ policy.
The moment we get policy guidance from the Centre, the state will revise its policy and issue instructions to all the authorities concerned.
The acquisition of farmland in Pen, Panvel and Uran tehsils of Raigad district had become a contentious issue ever since the Peasants and Workers Party (PWP) leaders took up cudgels on behalf of the farmers. The resistance gained momentum following violence at Nandigram in West Bengal.
On April 11, the Raigadh Collector wrote a letter to the Principal Secretary (Forest and Revenue), urging the government to clarify its stand on the land acquisition process in the district. The CM assured that he would be communicated the governments stand at the earliest.
Again, when it was pointed out to Deshmukh that Revenue Minister Narayan Rane was not aware of his announcement in the Legislative Council on March 23 that government would not acquire land for SEZs, he said, After we receive clear guidelines from the Centre, we will be holding a cabinet meeting and clarify our stand. It was pointed out to him that despite his announcement that the government would not acquire land for the SEZ, land acquisition process was on in full swing in Raigad district.
Deshmukh said, It is true that the government has already started the process of acquisition and the notices of section 4 have already been issued. It will go on to some point, but the final stage of fixing compensation and announcing awards in favour of the acquiring party will not be taken up at any cost.
No takers for management course
The academic council has now decided to enroll students to BMS on the basis of their Class 12 marks from next academic year. Over 50 colleges affiliated to the university provide the course.
The academic council members said the decision was taken after a number of seats in city colleges offering the BMS course fell vacant.
It was found that the numbers of BMS seats are more as compared to the number of students enrolling for the course. Figures depict that with 15,000 total numbers of seats available for the BMS course, the number of students enrolling for the course do not exceeds more than 7,000 every year. Thus, conducting CET becomes a time-consuming and fruitless exercise, said TA Shiware, an academic council member.
Colleges feel that the decision will pave way to students from various other streams like Arts and Science to enroll for the course. They also feel that the decision to scrap the CET will help colleges fill up the seats that have been otherwise going vacant.
It will also divert their focus towards securing good marks in Class 12 which has been always ignored as against the duration allotted for preparing for the entrance test, said Shiware.
UC Mashelkar, principal of Patkar College, said: Students have been opting for several other market-driven courses like Banking, Finance and BSc bio-tech. Another reason for the downward trend lies in the fact that the students pursuing their BMS course can only opt for the MBA degree programme after seeking the BMS degree.
Students have been opting for other professional courses as against the BMS course, as there are no entrance tests for majority of the professional courses introduced by the University of Mumbai. The course has failed to rise up to the academic standards due to the universitys failure in recognising it as a separate entity, said Rajkumar Bagadia, chief co-ordinator of the BMS course at SIES College.
Clear millmen's dues: Govt
The government told the owners to start a separate unit for the 277 workers who have not opted for VRS and added that they cannot force workers to quit jobs.
He added that in cases where the management has been found to have forced workers to quit, the government would reopen their cases and ensure that justice was done. He said this while replying to supplementaries on a calling attention notice moved by Tukaram Birkad (NCP).
Naik said the mill management had on April 13 withdrawn its application for closing the mill.
He said among the many reasons for closure of textile mills in the city included high costs of labour, state excise duty, cost of power and other factors.
'I am on deathbed... am telling the truth'
Im on my deathbed. I swear on God, Im telling the truth, Shakeela, the girl who was allegedly raped at the Tata Memorial Hospital, told her parents when the news of the arrest reached the family. The Bhoiwada police arrested Feroz Khan on charges of raping Shakeela (name changed).
The family alleges that the cops are trying to end the probe as soon as possible. This is a lie, said Israel Khan, Shakeelas uncle when he heard the news. The police want to resolve the matter as soon as possible, and is not concerned with finding out the truth.
Twenty-six-year-old Feroz Khan, a resident of Bhagat Singh Nagar slum colony, is the son of a carpenter.
Ferozs family is poor and the boy lives in our chawl. But I dont believe that he committed this deed. We have no complaints against him, said Israel, alleging that the boy might have buckled under pressure from the police.
The Khans have not received any official communication from the police. Some policemen came to our chawl and took five of our neighbours for questioning at #8.30 pm. It is possible that the police might have pressured them as well.
We will gladly give our consent to a DNA test. Let an unbiased body perform the test. The truth will be revealed, he challenged.
Shakeela even now insists that she was raped at the Tata Memorial Hospital.
She says that she is not lying. We questioned her repeatedly, but she still maintains her stand, said Israel.
With Shakeelas condition rapidly deteriorating, the familys primary concern right now is her health.
Shes suffering. A doctor from Delhi has promised treatment. We will send Shakeela and her mother to Delhi for treatment. We still have faith in God, said Jamal Khan, Shakeelas father.
Dr Narayan HKV, medical superintendent, TMH, said, We are yet to receive a communication from the police. If it is true, we are relieved that the matter has been cleared up.
Dud cheques cost Rs4.5 cr
The court passed the order following a complaint by Parel-based Kohetoor Stones against Allied Enterprise, opposite Old Customs House on Shahid Bhagat Singh Road.
Allied had issued three cheques worth Rs2.26 crore to Kohetoor in September 2004 for delivery of goods. The cheques bounced and Kohetoor filed a case in the Dadar court in November 2004 under section 138 of the Negotiable Instruments Act.
In their defence, Allieds partners Dilip and Tarun Mehta contended that they were not liable to pay the amount to Kohetoor and that the cheques had been obtained at gunpoint.
Magistrate RP Rahule examined witnesses and held that the claim of the cheques being taken at gunpoint could not be proved. Their entire defence fell through, Kohetoors lawyer Hasmukh Shah told DNA.
The court directed the Mehtas to pay the entire Rs4.55 crore within 45 days. If they fail, both partners will have to undergo further imprisonment of two months.
But after the Mehtas pleaded for some respite, the court issued a four-week stay on the order to arrest them, on condition that they deposit Rs22.50 lakh in court on Tuesday. They were also asked to furnish the bail amount of Rs30,000 each. The Mehtas are likely to appeal against the order.
Shiv Sena offered me ticket for Ramtek bypoll: Congress rebel
"Sena had offered me the ticket," Deshmukh, who contested the April 9 by-election unsuccessfully, told reporters at Vidhan Bhawan.
The former MPCC President was expelled from Congress on eve of the Ramtek polls for "anti-party activities".
He polled around 80,000 votes, thereby ensuring defeat of official Congress candidate and victory of Sena nominee, who won by around 37,000 votes in the constituency near Nagpur.
Deshmukh, a former state minister, claimed credit for ending the `Rane pattern', a reference to Revenue Minister and Congress leader Narayan Rane's move of getting his supporters to desert Sena and contest as Congress nominees.
Six of the seven Sena MLAs, who quit the party and joined Congress, were re-elected in the subsequent bypolls.
In Ramtek also, sitting Sena MP Subodh Mohite quit the seat and the Sena and followed Rane into Congress. He then contested Ramtek bypoll as a Congress nominee.
Rane has blamed Mohite's defeat to "sabotage" by some Congress leaders.
Stating that he supported a separate Vidarbha state, Deshmukh, who hails from the region, said he would highlight the issue of farmer suicides.
Bosses and men are top fraudsters: Study
Most of you who adjudicate on your office practices around the water-cooler or in the smoking room may have known that already. But the KPMG report is based on an analysis of 350 cases of corporate fraud committed in Europe, West Asia, India, and Africa.
Senior managers have access to confidential information, and because of their position, it is easier for them to bypass internal controls, said Deepankar Sanwalka, executive director and head of KPMG Forensic in India.
The typical fraudster is male and between 36 and 55 years old. By the time he starts profiting from his illegal schemes, he has usually been employed by the company for six years or more. He typically works in the finance department and skims the loot off alone.
KPMG found that in 91 per cent of the cases the fraudster committed offence several times before being discovered. In India and West Asia, corruption accounted for a third of the cases, followed by theft of cash and theft of other assets (24 per cent and 17 per cent, respectively).
In most instances, perpetrators exploited weak internal controls. And the comeuppance usually was delivered not because of diligent audits, but by anonymous tip-offs (25 per cent). In fact, the study revealed that only 10 per cent of fraud cases were uncovered by internal controls.
KMPG found that seniority was no constraint for a fraudster. As much as 11 per cent of offences were committed by board members. And since 60 per cent of the fraudsters were members of senior management, weak internal controls and abuse of control accounted for 85 per cent cases of fraud. Three out of ten offences were committed by an outsider, usually in collusion with an employee.
In 46 per cent of fraud cases in India and West Asia, each illegal transaction was worth up to 1,000 euros. In Europe, the corresponding figure was 30 per cent.
Editor of Mumbai daily held on extortion charge
Sohan Jain, editor of 'Vividh Samachar', was arrested along with one Balu Naval from the publication's office in Dongri late on Tuesday evening for demanding the extortion sum, they said.
"The accused had been publishing false news articles about Gunasingh Nadar's cutlery business since March this year and threatened him that he would have to shut his shop if the stories continue to appear in the paper and demanded Rs30,000 as an extortion sum," they said.
